Introduction

Your privacy is very important to Kloudless, Inc. (“Kloudless”). This privacy policy (“Policy”) applies to the Kloudless Websites — www.kloudless.com, products and services and describes how personal information is collected, used, disclosed, and protected by Kloudless. If you use the Kloudless site and services as part of an entity or organization that has Enterprise service with Kloudless, the individual terms of the organization’s contract for Enterprise service may restrict our collection and/or use of your personal information more than what is described here in this Policy.

Information Collected

We collect information from you in various ways when you use our Websites and services. We may also supplement this information with information from other companies. We collect two general types of information, namely personal information and aggregate data. As used in this Policy, the term “personal information” means information that specifically identifies an individual (such as a name and email address), and demographic and other information when directly linked to information that can identify an individual.

Our definition of personal information does not include “aggregate” data. Aggregate data is information we collect about a group or category of services or users from which individual user identities have been removed. In other words, no personal information is included in aggregate data. Aggregate data helps us understand trends in our users’ needs so that we can better consider new features or otherwise tailor our services. This Policy in no way restricts or limits our collection and use of aggregate data, and we may share aggregate data about our users with third parties for various purposes, including to help us better understand our customer needs and improve our services and for advertising and marketing purposes.

The following are the specific types of information you give to us. We collect information you give us on our Website and when you register for and use our services.

Registration information — When you register to use our service, we collect your name and email address. You log into your Kloudless account to access our services using Google’s sign in functionality. This feature uses Google’s application programming interface (API) to authenticate your identity and automatically share certain personal information with us like your name and email. We use similar methods to connect your cloud storage accounts.

Attachment information — When you use our platform to manage your attachments, we keep some of the information about an attachment (filetype, size, filename, email subject, email body) on a database on one of our servers.

Payment information — If you choose to use a paid Kloudless account or service, our payment-processing vendor collects your credit card information and billing address.

Automatically collected information — As is true of most Websites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data. We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole. We do not link this automatically collected data to personally identifiable information.

Cookies and Web Beacons — We may also use certain kinds of technology such as cookies and Web beacons to collect information. Among other things, the use of cookies and Web beacons enables us to improve our Websites and emails by seeing which areas and features are most popular, to count the number of computers accessing our Website, to personalize and improve your experience, to record your preferences, and to allow you to visit our Website without re-entering your member ID and/or password. A cookie is a small amount of data which is sent to your browser from a Website’s computers and stored on your computer’s hard drive. Most browsers automatically accept cookies as the default setting. You can modify your browser setting to reject our cookies or to prompt you before accepting a cookie by editing your browser options. However, if a browser is set not to accept cookies or if a user rejects a cookie, some portions of the Website and services may not function properly. For example, you may not be able to sign in and access certain Web page features or services. A Web beacon is an electronic image, also called a “gif” that may be used on our Web pages to deliver cookies, count visits and compile statistics on usage and campaign effectiveness or in our emails to tell if an email has been opened and acted upon.

Third Party Cookies — Kloudless uses third parties to track and analyze usage and volume statistical information from individuals who visit the Kloudless website. Kloudless uses this information to serve users better. The use of cookies by our service providers is not covered by our privacy policy. We do not have access or control over these cookies.

Use of Personal Information

In general, we use your personal information to process your requests or transactions, to provide you with information or services you request, to inform you about other information, events, promotions, products or services we think will be of interest to you, to facilitate your use of, and our administration and operation of, the Website and services and to otherwise serve you and our users. For example, we may use your personal information:

  • to request feedback and to enable us to develop, customize and improve the Website and our publications, products and services;
  • to conduct marketing analysis, to send you surveys or newsletters, to contact you about services, products, activities, special events or offers from Kloudless or our partners and for other marketing, informational, product development and promotional purposes;
  • to send you a welcoming email and to contact you about your use of the Website and services; to respond to your emails, submissions, comments, requests or complaints; to perform after-sales services; to anticipate and resolve problems with our service; to respond to customer support inquiries, for assistance with our product and service development; and to inform you of updates to products and services from Kloudless that better meet your needs;
  • to store contacts you enter or upload into your contacts list for your private use and viewing;
  • to send emails to users you invite (and contacts you invite to become users) to collaborate;
  • to enable you to share files with users you designate;
  • to contact you if you win a contest; and
  • for other purposes about which we notify you.

Kloudless may store and process personal information in the United States and other countries.

Sharing of Personal Information

We will share your personal information with third parties only in the ways that are described in this privacy policy. We do not sell your personal information to third parties.

Service providers — We may use third-party partners to help us operate and maintain our Website and deliver our products and services. We may also share your Personal Information and Website Usage Information with our service providers and other third parties (“Affiliated Parties”) that provide products or services for or through this Website or for our business (such as website or database hosting companies, address list hosting companies, communications providers, email service providers, analytics companies, distribution companies, fulfillment companies, credit card processing companies and other similar service providers that use such information on our behalf).

Third-party service providers are contractually restricted from using or disclosing the Personal Information and Website Usage Information except as necessary to perform services on our behalf or to comply with legal requirements, or otherwise subject to the terms of this Policy.

Enterprise contract — If you are an individual Kloudless registered user, and the domain of the primary email address associated with your Kloudless account is owned by your employer and that email address was assigned to you as an employee of that organization, and that organization wishes to establishes a Kloudless corporate account and add you to it, then certain information concerning past use of your individual account may become accessible to that organization’s administrator including your email address.

Aggregate statistics — We may disclose non-personally identifiable aggregate statistics regarding user behavior as a measure of interest in, and use of, our Website and emails to third parties in the form of aggregate data, such as overall patterns or demographic reports, which do not describe or identify any individual user. Information relating to aggregate statistics may be collected through the use of third-party cookies and other third party tracking devices.

Legally compelled disclosure — We may disclose your Personal Information if required to do so by law or subpoena or if we believe that such action is necessary to (a) conform to the law, comply with a judicial or court order or comply with legal process served on us or Affiliated Parties; (b) protect and defend our rights and property, the Website, the users of the Website, and/or our Affiliated Parties; or (c) act under circumstances to protect the safety of users of our Website, us, or third parties.

Business transfer — If Kloudless is involved in a merger, acquisition, or sale of all or a portion of its assets, you will be notified via email and/or a prominent notice on our Website of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

User Access and Choice to Opt In/Out

If your personal information changes in any way, we invite you to correct, delete or update your information as soon as possible. You can make updates to your profile information by logging into your account on Kloudless at any time. You can also request changes or access to your information by emailing support@kloudless.com.

If you no longer desire our service, you may email support@kloudless.com to delete your account. We will respond to your request to access within 30 days.

Kloudless may send you communications or data regarding our Websites and services, including but not limited to (i) notices about your use of our Websites and services, including any notices concerning violations of use, (ii) updates, and (iii) promotional information and materials regarding our products and services. You may opt-out of receiving promotional emails from Kloudless by following the opt-out instructions provided in those emails. You may also opt-out of receiving promotional emails and other promotional communications from us at any time by emailing support@kloudless.com with your specific request. Opt-out requests will not apply to transactional service messages, such as security alerts and notices about your current account and services. To stop receiving emails you would have to deactivate your account. Please email support@kloudless.com from the email address associated with your kloudless account with a request to deactivate your account and we will respond to your request within 30 days.

Information Security

Kloudless takes reasonable steps to protect information we collect from you to prevent loss, misuse and unauthorized access, disclosure, alteration, and destruction. In addition, highly confidential personal information such as credit card number and password that we request from you on our Website is protected with encryption, such as Secured Socket Layer (SSL) protocol, during transmission over the Internet.

We follow generally accepted standards to protect the personal information submitted to us, both during transmission and once we receive it. While we take reasonable efforts to guard personal information we knowingly collect directly from you, no security system is impenetrable. In addition, we cannot guarantee that any passively-collected personal information you choose to include in documents you store on our systems are maintained at adequate levels of protection to meet specific needs or obligations you may have relating to that information.

Updates to this Policy

We may change this Policy from time to time. If we make any changes to this Policy, we will change the “effective date” below. If there are material changes to this Policy, we will notify you by email (sent to the e-mail address specified in your account) or by means of a notice on this Website prior to the change becoming effective. We encourage you to check this Policy whenever you use our Websites and services to understand how your personal information is used.

Additional Information

Links to 3rd Party Sites — Our Website includes links to other Websites whose privacy practices may differ from those of Kloudless, Inc. If you submit personal information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Website you visit.

Blog/Forum — Our Website offers publicly accessible blogs or community forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. To request removal of your personal information from our blog or community forum, contact us at support@kloudless.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Social Media Widgets — Our Website includes Social Media Features, such as the Facebook Like button (and Widgets, such as the Share this button or interactive mini-programs that run on our site). These Features may collect your IP address, which page you are visiting on our site, and may set a cookie to enable the Feature to function properly. Social Media Features and Widgets are either hosted by a third party or hosted directly on our Site. Your interactions with these Features are governed by the privacy policy of the company providing it.
